A tree fell on my property and caused vandalize to the shingles and other items before I moved into the home. The HOA hasn't done anything to repair these problems. Is the HOA responsible for fixing this impairment?
There is a situation where the HOA is responsible for repairing exterior defacement and sometime interior damage, when your home is a condominium. The individual owners are responsible for insuring their interior walls, but the HOA holds the insurance policy for adjectives common property such as the exterior roof and walls. Interior sabotage condo owners' property arising from a damaged roof due to twirl and rain may consequently also be covered by the HOA policy. Condo owners need to be powerfully informed about the HOA policy to select their own coverage correctly.
I doubt that the HOA have any responsibility here. The responsibilty will lie next to the owner at the time the tree fell. That is, if it fell after the closing, you were the owner, and you will be the one to get hold of it fixed. Hopefully, you insured the house at the time of closing, and can get lend a hand from your insurer. If the tree fell before closing, the previous owner should hold fixed it, or adjusted the selling price to compensate you.
